Introduction

Welcome to Home4Eat! These Terms and Conditions (“Terms”) apply to your use of the Home4Eat website, mobile application and any other related platform or service (collectively, the “Service”).

Home4Eat is a platform that allows users to book gastronomic experiences and services in customers' homes, in the homes of local gastronomic ambassadors, as well as in other appropriate locations, among other services related to gastronomy. Home4Eat is not a food service provider, but merely an intermediary that connects users with companies or local gastronomic ambassadors offering services or experiences.

These Terms establish the legal obligations and responsibilities between Home4Eat and its users. By using the Service, you agree to these Terms and the Home4Eat Privacy Policy, which describes how we collect, use and share your information.

Legal Entity

Home4Eat is owned by Daniel da Silva Castro Pereira, and is a sole proprietorship company with NIF:218543670, with its tax address at Rua Guilherme Duarte Camarinha, 38 6B, 4400 -703 in Vila Nova de Gaia – Portugal

1. Access Home4Eat

By logging in, you agree to:

  • Give access to your personal Facebook profile for the purpose of registration validation, implying access to your essential data;

  • Respect the rules of the community you are part of, behave with the civility and rigor recognized by Home4Eat members;

  • Keep your registration personal and non-transferable, not passing it on to third parties;

  • Report to Home4Eat any misuse of your personal account;

2. Use of the Service

Home4Eat permits you to access and use the Service only if you have at least 18 yearsof age or the age of legal majority in your country of residence. If you do not meet these age requirements, you may not use the Service.

Gastronomic Ambassadors Validation:

 
1. Careful Selection:
a) Admission as Gastronomic Ambassador is subject to a rigorous selection process;

b) Candidates must demonstrate experience and passion for the area of ​​gastronomy in which they work;

2. Maintenance of Gastronomic Ambassador/Partner:
a) Permanence as Gastronomic Ambassador is subject to regular evaluation and alignment with brand values ​​(Home4Eat);
b ) Home4Eat reserves the right to terminate the partnership in case of significant deviation from the established criteria;

3. Reservations

When making a reservation at Home4Eat, you agree to comply with our Terms and Conditions, as well as in specific cases with the Conditions mentioned in the gastronomic ambassador advertisements. Home4Eat is not part of any contract between the website user and the gastronomic ambassador and/or company. It is the website user's responsibility to read and understand our Terms and Conditions, as well as in specific cases, the Terms and Conditions of the gastronomic ambassador or company before making a reservation.

Home4Eat does not guarantee the availability of the Service or the availability of a specific gastronomic ambassador. Prices and availability of gastronomic experiences are subject to change without prior notice.

4. Advertising/Sponsorships

Home4Eat may contain advertising and other references to brands, products and/or services of a commercial nature. Advertisers and sponsors are responsible for ensuring that their promotional materials comply with current laws and codes — Home4Eat expressly declines any responsibility for errors or inaccuracies that they may contain.

Any relationship established between the user and advertisers or sponsors will be their exclusive responsibility, and Home4Eat can never be held liable, except to the extent imposed by law.

5. Links to Other Sites

Home4Eat informs that, if it provides links to third-party websites or content provided by third parties, these links are for exclusively informative purposes and for the user's convenience. The links you may find that redirect you to other web pages outside the domain of Home4Eat's servers may cause losses or damage for which Home4Eat is not responsible. The use of other web pages is subject to the terms and conditions indicated on each such other page.

6. Cancellation

If the user needs to cancel a reservation, they must do so through the Home4Eat Service, via email: support@home4eat.com. User cancellation policies can be consulted here, and it is important that users read and understand the Terms and Conditions before making the reservation.

Home4Eat is not responsible for any costs, expenses, losses or damages resulting from cancellations, changes or other interruptions to the dining experience, including, but not limited to, travel costs, accommodation or other additional costs.

7. User Responsibility

Users (gastronomic ambassadors) can create and post content on the website, including images, descriptions and comments.

Users agree that the content they create is their sole responsibility and that Home4Eat do not assume responsibility for that content.

Users agree not to post content that is illegal, defamatory, pornographic, discriminatory or otherwise offensive

Home4Eat may remove any content that violates these Terms and Conditions or is considered inappropriate for the platform.

The user of the website is solely responsible for all activities that occur under their Home4Eat.

The user must keep their account secure and must not share their login information with third parties.

The user is responsible for any activity carried out on their account, including bookings made by third parties with access to their account.

The user agrees to indemnify and hold Home4Eat harmless in the event of misuse of the account.

8. Amounts to be Collected, Payments and Receipts

8.1 Price

The values presented by the partner or freelancer (ambassador) must be presented with VAT at the legal rate of the country where they are located. and are subject to change at any time without prior notice.

The platform charges 20% of the value of the service presented by the gastronomic Ambassador or partner.

8.2 Payment

Payment for services at Home4Eat must be made at the time of booking. Payment can be made by credit card or other online payment method available on the website.

If payment is not made at the time of booking, the booking will not be considered confirmed and the event will not be scheduled.

8.3 Receipt

Payment to the Gastronomic Ambassador or partner will be made after the service has been fully carried out and against invoice or receipt.

 

9. Cancellation Policy

10.1 Cancellation by Home4Eat

We reserve the right to cancel an experience or service at any time for unforeseen reasons, such as illness, emergencies or other unforeseen circumstances. If Home4Eat has to cancel an experience/service, we will contact the customer and offer a full refund or the opportunity to reschedule a new experience or service.

10.2 Cancellation by the Gastronomic Ambassador

If the Gastronomic Ambassador needs to cancel an experience or service, they must contact the customer immediately. And the customer will have the opportunity to reschedule the event or will receive a full refund.

10.3 Cancellation by the Customer

10.3.1 In case of cancellation by the customer, they must immediately contact the Gastronomic Ambassador responsible for the experience or service, or via email: support@home4eat.com. The refund dates corresponding to each cancellation notice are detailed in the table below for your information and reference.

NOTE: In the refund table, in case of cancellation between 7 to 4 days and equal to or less than 3 days, the Home4Eat fee will be deducted of the total amount paid to the Gastronomic Ambassador or Partner.

 

10.3.2 On certain occasions, Gastronomic Ambassadors may offer more flexible cancellation terms than those stipulated in our standard policies, in this case it will only be possible to be – Free cancellation up to 2 days before the start of the event. These changes will be clearly communicated in the service or event announcement. Please always carefully check the service or event cancellation policies before booking.

10.4 Reservations that are less than 24 hours before the event

If the event reservation is confirmed by the Gastronomic Ambassador and takes place in less than 24 hours, payment must be made as soon as possible (next few hours) and before the event takes place. In this specific situation (less than 24h), if the customer cancels the service or experience, will not be refunded.

10.5 Cancellation of visits and/or gastronomic events (Fairs and Festivals)

In case of cancellation by the customer, there will be no right to a refund for this service.

10.6 Refunds

All refunds will be processed by Home4Eat and the time taken to process them may vary, but generally takes 5 to 10 business days . In specific cases, Home4Eat reserves the right to withhold a service fee. The amount to be refunded will be deducted from the fees and commissions already charged by Home4Eat, as well as bank fees and other expenses related to the refund, if applicable.

11. Intellectual Property Rights

All content available on the Home4Eat website, including texts, images, graphics, logos, icons, photographs, audio and video clips, data compilations and “software”, are the property of Home4Eat or its content providers, and is protected by applicable intellectual property laws. Users may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any content from the Home4Eat website without prior written consent Home4Eat, or the applicable content owner.

12. Limitation of Liability

Home4Eat will not be liable for any loss or damage arising from the use of, or inability to use, our services, including, without limitation, direct, indirect, incidental, special or consequential damages, lost profits or damages resulting from any errors, omissions or other inaccuracies on the website, or in the content available on the website.

Home4Eat makes no express or implied warranties about the site and its services, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Home4Eat does not guarantee that the website will be free from errors, interruptions, viruses or other defects.

13. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Portugal, without giving effect to any contrary provisions of other laws or jurisdictions. Any disputes arising out of or in connection with these Terms and Conditions shall be submitted to the exclusive jurisdiction of the Portuguese courts.
